Permanent Residency After I turn 45?
We are often asked by clients, what are my options to obtain permanent residency after I turn 45? This is because many permanent work visas such as General Skilled Migration Visas (Subclass 189, 491 or 190) or Permanent Employer Sponsored Visa (Subclass 186) have a cut off age of 45.
It is true that once you turn 45, you do have fewer options for Permanent Residency. However, there are still several options available. This video will outline some options that may be available to you:
- The Standard Temporary Employer Sponsor Visa (Subclass 482) does not have an age limit. Please note, this is a temporary visa only . However, there are certain exemptions to this such as in Designated Area Migration Agreements (DAMA) where the age limit can be up to 50 or in certain areas 55. DAMA areas are certain regional regions in Australia that the government is really trying to encourage skilled migration. There are currently 7 Designated Migration areas around Australia.
- In addition to this, there are certain age exemptions in certain Labour Agreements such as the Horticulture Labour Agreement
- The Global Talent visa could be another option. The Global Talent visa was set up to attract highly skilled and educated applicants in certain very specific target sectors. It is designed for people who have exceptional and outstanding achievement in their field. The department has selected the below fields:
- Resources
- Agri-food and AgTech
- Energy
- Health industries
- Defence, advanced manufacturing and space
- Circular economy
- DigiTech
- Infrastructure and tourism
- Financial services and FinTech
- Education
- Many business or investment visas such as the business and innovation visa (Subclass 188A) also have an age limit up to 55. With most of these visas, a large amount of funding is required to be made into an Australian business or investment.
- If you have a partner who is an Australian citizen or permanent resident, there is no age limit on partner visas.
- Finally, if you have a child who is an Australian citizen or permanent resident, you may want to look into the Parent or Aged Parent Visas. There is no age limit on parent or aged parent visas to Australia.
